These Terms & Conditions (“Terms”) govern your membership and participation in classes, events, and activities provided by Befriend Investment LLC, doing business as Befriend Body Studio (“Befriend Body Studio,” “Studio,” “we,” “us”). By signing up for a membership, trial, or participating in any Studio activity, you agree to the following:

1. Memberships & Trial Periods

• Memberships are month-to-month and auto-renew unless canceled in accordance with these Terms.

• We do not provide refunds or class credits for unused classes.

• New members may begin with a Trial Period. At the conclusion of the Trial:

  • Membership will automatically renew at the Tier 2 membership level.

  • Members may cancel or downgrade to Tier 1 prior to renewal.

• If no action is taken, the Tier 2 membership will begin automatically.

• No refunds or credits will be issued for unused trial classes.

Cancellation requires at least 5 business days’ written notice prior to the next billing date.

2. Class Usage & Credits

• Monthly memberships include a set number of classes. Unused classes do not roll over to the next month.

• Moms may use their allotted monthly classes toward eligible kid-inclusive classes (such as Big Strength & Little Strength).

• No refunds or class credits will be issued for unused monthly classes.

• Drop-In Option: Single class purchases are available and valid only for the reserved class. Drop-ins are non-refundable and non-transferable.

3. Late Cancellation & No-Show Policy

We understand that life with kids can be unpredictable. To keep classes running smoothly while respecting all members’ time:

• Cancellations: Must be made at least 2 hours before class start time.

• Late Cancellations (<2 hours):

  • Active Mover Members: The class will be deducted from your monthly allotment.

  • Drop-In Purchases: The class is forfeited and non-refundable.

  • Unlimited Members: No class is deducted, but 2+ late cancels may result in a warning.

• No-Shows (failure to attend a reserved class):

  • Active Mover Members: The class will be deducted from your monthly allotment.

  • Drop-In Purchases: The class is forfeited and non-refundable.

  • Unlimited Members: A $10 fee will be charged per no-show.

• Grace Policy: Each member is allowed one (1) grace late cancel or no-show per calendar month without penalty. After this, the above policies apply.

• Studio Discretion: Exceptions may be made in the event of emergencies, solely at the Studio’s discretion.

Workshops & Event Cancellation Policy 

• Members (Active Membership Holders):

  • Cancellations 48 hours or more before an event = receive studio credit toward a future workshop or event (no refunds).

  • Cancellations within 48 hours of an event OR no-shows = no credit and no refund (full forfeiture).

• Non-Members (Drop-In Participants):

  • Cancellations 48 hours or more before an event = may transfer to another event, subject to availability, at Studio’s discretion.

  • Cancellations within 48 hours of an event OR no-shows = no credit and no refund.

• Studio Cancellations: If the Studio cancels a workshop or event, all participants (members and non-members) receive a full refund or option to transfer credit to another event.

• Outside Partner Policies: If the event involves an outside professional, organization, or venue, their policies may apply in addition to the Studio’s.

 

 

2. Health & Safety

• All members must disclose if they are pregnant, breastfeeding, newly postpartum, or experiencing significant medical conditions.

• Participation requires clearance from your physician.

• You acknowledge that Befriend Body Studio is not a medical provider and that information provided in classes, workshops, or communications is not medical advice.
  You assume full responsibility for your participation in physical activity.

3. Waiver & Release of Liability

⚠️ Important – Please Read Carefully

By participating in any class, event, or activity at Befriend Investment LLC d/b/a Befriend Body Studio, you agree:

• You voluntarily participate at your own risk.

• You waive and release Befriend Investment LLC, its owners, officers, staff, contractors, and partners from any and all claims of injury, illness, property damage, or loss that may occur during or after participation.

• This waiver applies to all activities, including:

  • In-studio classes,

  • Kids Play Area usage,

  • Workshops and special events,

  • Off-site or partner-location events,

  • Consumption of food or beverages at events.
     

 

4. Studio Etiquette

• Respect instructors, staff, and other members at all times.

• Cell phone use should be limited and non-disruptive.

• The Studio reserves the right to remove any member or guest for disruptive or unsafe behavior.

 

Children

• Children may remain in the Kids Play Area or stay close to their parent/guardian during workouts.

• Parents are fully responsible for supervising their child at all times.

• Studio members or staff may, if necessary, interact with your child to assist you in completing your workout or to protect their safety. This may include holding, moving, or redirecting your child within the Studio.
   

• By bringing your child, you consent to this assistance. If you do not consent, you must notify the Studio in writing.

• The Studio reserves the right to ask any parent/child to leave if a child’s behavior is disruptive.

• You expressly waive the Studio of liability for any child injury, illness, or safety incident.
   

 

5. Workshops, Events, & Collaborations

• The Studio may host workshops and events featuring outside professionals, organizations, or companies.

• Food or beverages (including smoothies or snacks) may be served. Participation and consumption are at your own risk.

• Events may occur at the Studio, at a partner’s location, or at a third-party private or public venue.

• All Terms, including the Waiver & Release, apply to off-site events.

• For Cancellation Policy regarding Workshops and Events, please see above under Section 3.

 

6. Communications

• By providing your phone number and email, you consent to receive SMS text messages and emails from the Studio for updates, scheduling, billing, and promotions.

• You may opt out at any time by following unsubscribe instructions.

 

7. Payment Policies

• Membership dues and fees are automatically billed to the payment method on file.

• Members must ensure payment information is current.

• Failed payments may result in suspension of membership until resolved.

• A $15 late fee may be applied to overdue balances.

• Chargebacks not resolved in the Studio’s favor may result in immediate membership termination and collection action.
   

 

8. Membership Freezes & Suspensions

• Members may request a freeze for qualifying reasons (pregnancy, injury, extended travel).

• Requests must be submitted in writing and may require documentation.

• Freezes must be at least 2 weeks and no more than 3 months.

• Billing resumes automatically at the end of the freeze unless canceled.

 

9. Photo & Video Release

• By entering the Studio or attending events, you grant Befriend Investment LLC d/b/a Befriend Body Studio the right to photograph or record you.

• These images may be used for promotional or educational purposes without compensation.

• To opt out, notify the Studio in writing before participation.
   

 

10. Intellectual Property

• All content, branding, class names, and materials are the property of Befriend Investment LLC.

• Members and guests may not reproduce, share, or commercially exploit Studio content without written permission.

 

11. Age Requirements

• You must be 18 years or older to hold a membership independently.

• Minors may participate only with a parent/guardian present and in compliance with Studio rules.

 

12. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of [Insert State].

• Disputes shall first be addressed in good faith discussions between you and the Studio.

• If unresolved, disputes will be handled exclusively in the state and federal courts of Oklahoma.

• You waive any right to a jury trial.

• Either party may seek immediate equitable relief (injunction) if necessary.
